Die Arbeit unterzieht die asylgerichtliche Praxis einer kritischen Analyse und deckt deren Widersprüche und normativ nicht gerechtfertigten Eigenheiten auf mit dem Ergebnis, dass die Gerichte der Verpflichtung zur umfassenden Sachverhaltsaufklä-rung nicht nachkommen, sondern durch extensive Mitwirkungspflichten die Verantwortung für erfolglosen Rechtschutz dem Asylkläger aufbürden.
N2  - The conscientious ascertainment of facts is a basic precondition of any legal decision concern-ing asylum seeking. The German judicial practice in asylum law is subject to this analysis. It reveals the contradictions and particularities compared to normal administrative law and its judicial application: Law courts usually do not meet their obligation to thoroughly clear up facts because they are supported by a legislation that attaches more importance to the acceleration of procedure than to correctness of results. Moreover, they create a number of asylum seekers’ duties to shift the responsibility even for ineffective legal protection on those seeking asylum. The study proves that law-courts according to the rules of court are liable to do anything possible to clear up the facts of persecution to make lawful decisions.
