• Das Rechtskonzept "Kindeswohl" ist erst seit wenigen Jahrzehnten als das zentrale familienrechtliche Leitprinzip anerkannt und insbesondere hinsichtlich der konsequenten Bezugnahme auf die Persönlichkeitsrechte des Kindes als zeitgeschichtliches Phänomen des 20. Jahrhunderts zu betrachten. Die vorliegende Arbeit befasst sich mit der Entwicklung der gesetzlichen Verankerung und Konkretisierung des Kindeswohl-Prinzips sowie dessen Interpretation durch die Rechtsprechung in den ersten 100 Jahren seit Inkrafttreten des Bürgerlichen Gesetzbuches.
