  • Das Gesetz zur Modernisierung des Schuldrechts vom 26. November 2001 hat das Schuldrecht teilweise grundlegend geändert. Die Schuldrechtsreform hatte zum Ziel, durch Vereinfachung und Vereinheitlichung die Kodifikation zu stärken. Die Arbeit untersucht anhand ausgewählter Probleme, ob dieses Ziel erreicht wurde. Der erste Teil der Arbeit widmet sich insbesondere der Bestimmung der Reichweite des Sachmangel- bzw. Beschaffenheitsbegriffs unter Berücksichtigung europarechtlicher Vorgaben. Die Arbeit gelangt zu dem Ergebnis, dass derDas Gesetz zur Modernisierung des Schuldrechts vom 26. November 2001 hat das Schuldrecht teilweise grundlegend geändert. Die Schuldrechtsreform hatte zum Ziel, durch Vereinfachung und Vereinheitlichung die Kodifikation zu stärken. Die Arbeit untersucht anhand ausgewählter Probleme, ob dieses Ziel erreicht wurde. Der erste Teil der Arbeit widmet sich insbesondere der Bestimmung der Reichweite des Sachmangel- bzw. Beschaffenheitsbegriffs unter Berücksichtigung europarechtlicher Vorgaben. Die Arbeit gelangt zu dem Ergebnis, dass der Beschaffenheitsbegriff des § 434 Abs. 1 S. 1 BGB alleine durch die Parteivereinbarung bestimmt werden sollte. Des weiteren tritt die Arbeit für eine Neuordnung des systematischen Verhältnisses zwischen allgemeinem Leistungsstörungsrecht und Kaufgewährleistungsrecht ein. Im zweiten Teil der Arbeit wird die Verkäuferhaltbarkeitsgarantie nach § 443 Abs. 1 S. 1 Alt. 2 BGB untersucht. Die Verletzung einer Verkäuferhaltbarkeitsgarantie wird im Ergebnis dogmatisch als Sonderfall des Sachmangels eingeordnet. Der dritte Teil der Arbeit behandelt schließlich die Nachlieferung nach § 439 Abs. 1 Alt. 2 BGB beim Stückkauf. Ausgehend von einer Begriffsbestimmung zeigt sich insbesondere, dass bei einem wirklichen Stückkauf denknotwendig keine Nachlieferung einer mangelfreien Sache geschuldet sein kann.show moreshow less
  • The Act on the Modernisation of the Law of Obligations dated 26 November 2001 has amended the law of obligations materially. The reform of the law of obligations intended to strenghten the German Civil Code by way of simplification and unification. On the basis of selected problems, the dissertation analyses whether this aim has been achieved. The first part of the dissertation addresses in particular the determination of the scope of certain legal terms relating to defects as to quality. The first part of the dissertation addresses in particular the determination of the scope of certain legal terms relating to defects as to quality. The dissertation concludes that defects as to quality within the meaning of section 434 para 1 sentence 1 German Civil Code should exclusively be identified in line with the individual contractual arrangements of the parties. Further, the dissertation argues for a revision of the systematics between the general provisions on breach of contract and the specific provisions foreseen for sale and purchase agreements. The second part of the dissertation looks into the vendor guarantee within the meaning of section 443 para 1 sentence 1 German Civil Code. As a result, the breach of such vendor guarantee can be classified as a specific defect as to quality within the meaning of section 434 para 1 German Civil Code. Finally, the third part of the dissertation covers subsequent deliveries within the meaning of section 439 para 1 German Civil Code where the object of purchase has been individualised.
