Ein rechtsvergleichender Beitrag zur Begrenzung der Haftung nach Vertragsrecht N2 - Das Rechtsinstitut der Culpa in contrahendo (Cic) wurde von der deutschen Rechtswissenschaft und Rechtsprechung entwickelt, um die vertraglichen Haftungsnormen einschl. der Schutzpflichten für Leib und Eigentum auf den vor-vertraglichen Bereich zu erstrecken. Diese Erstreckung ist für die genannten Schutzpflichten weder dogmatisch begründbar noch praktisch notwendig. Die funktionell für den Schutz des allgemeinen Erhaltungsinteresses zuständige Deliktsordnung reicht hier völlig aus. Der auf den vor-vertraglichen Bereich erstreckte Schutzbereich des Schuldvertrags ist durch dessen Funktion als rechtliches Instrument des Güter- und Leistungsaustauschs bestimmt und erfasst nicht das Interesse an der Integrität der gegenüber jedermann geschützten Rechtsgüter, insbes. an der Unversehrtheit von Person und Eigentum. Personen- und Sachschäden sind für das vor-vertragliche Verhandlungsschuldverhältnis ebenso wenig normrelevant wie für das Zielvertragsverhältnis. Der Schutzbereich des Cic-Schuldverhältnisses ist daher auf Verhalten zu beschränken, das Bezug zu dem konkret intendierten Leistungsverhältnis (Zielvertrag) aufweist. N2 - Culpa in contrahendo (Cic) has been invented by German scholars and judges in order to broaden the scope of application of the regime of contractual liability (including the rules protecting the integrity of the body and property of the contracting partner) into the pre-contractual area. This expansion is neither dogmatically founded nor necessary from a practical point of view, as the functionally appropriate torts regime is completedly sufficient to cope with the pertinent cases. The scope of application of the contractual liability regime is restricted by the function of contracts, i.e. to legally govern the interchange of commodities and services ; it does not cover tort situations. The same must prove right for the pre-contractual liability regime derived from the liability regime of the intended contract. Therefore, Cic does not cover cases of bodily injuries and destruction of objects but has to be restricted to the breach of pre-contractual duties relating to the content of the contract in view. Additionally, clusters of dense granules were observed in the cytoplasm which were often associated with polysomes and strongly resembled the so-called "heavy bodies" known in particular in diverse oocytes. The functional meaning of these structures is discussed. Moreover, it is deduced from the ultrastructural identity of the pore complexes in the nuclear envelope and the cytoplasmic and intranuclear annulate lamellae that the pore complex material with its highly ordered arrangement is not a structure characteristic for nucleocytoplasmically migrating material, but rather is a general structural expression of a tight binding of ribonucleoprotein (RNP) to cisternal membranes. The pore complexes are thought of as representing sites of a RNP-storage. A similar functioning is hypothesized for the "heavy body"like aggregates. To the current hypotheses on the formation of annulate lamellae and the nuclear envelope, which are based on the concept of membrane continuities and constancies, the alternative view of a self assembly mechanism of membrane constituents on nucleoprotein structures is added.
